The Bain Group - Family Law
What is Family Law?
The Bain Group offers representation in several Family Law areas including adoptions, private terminations of parental rights, name changes, separation agreements, and absolute divorces. We realize that the types of decisions you must make regarding your family's future are more important than anything else, and we are here to guide you through this process. Hiring an experienced attorney to assist you is critical when it comes to protecting your rights.
Adoption
Adopting a child will undoubtedly be the most rewarding thing you will ever do in your life. The last thing you need is to learn that after months of meeting deadlines, giving notices, and obtaining legal clearances, your petition is being dismissed because some minor detail was overlooked. Adoption can seem like a massive undertaking, especially given the endless amount of paperwork involved. However, whether it is a private adoption, step-parent adoption, relative adoption, or foreign re-adoption, we will provide you with all of the information you need to ensure that your child legally becomes yours.
If you are just beginning the process, you probably have many questions, including whether a biological parent can revoke his or her consent once it is given; whether any money can be paid to the biological mother; and what options exist to get legal clearance on a biological or legal parent if he or she does not give his or her consent. One method for obtaining legal clearance on a parent in an adoption is through a private termination of parental rights, and if that is the only option, we are prepared to represent you in juvenile court for that proceeding. We can answer all of your other questions as well so that there will be no surprises along the way.
Separation & Divorce
Unfortunately, family law includes not only additions to families, but also involves dissolutions of families. During this difficult time, it is not unusual for your emotional reactions to interfere with rational thinking. That is why it is essential that you talk to an attorney before taking any actions or making any decisions. Certain decisions that are made with emotions can lead to unintended results. For instance, if you move out of the marital home, this could affect your obligation to pay or ability to receive alimony. This is also true of extramarital affairs, and in that situation, the third party could also face potential legal claims. It is important to speak with an attorney as soon as you are contemplating separation, before any decisions are made, to ensure that all of your questions are answered up front.
The Bain Group, PLLC works with couples who have amicably reached agreements as to the distribution of property, visitation rights, custody, and child support and/or alimony payments. We will draft the legal separation agreement which will bind the parties in case one party defaults on the Agreement.
