We can also advise you regarding legal questions concerning title to your property, title insurance, and the covenants and conditions of your loan documents. We represent the mortgage lender to the extent of assuring full compliance with its loan closing instructions.

We are responsible for conducting the title examination of the property; ensuring the deed of conveyance and loan closing documents have been properly prepared and executed; receiving and disbursing the closing funds properly and pursuant to the HUD-1 Settlement Statement; reviewing the survey prior to the closing; properly closing the transaction and recording the deed and deed of trust; and ensuring the owner’s and lender’s policies of title insurance are issued in proper form.

If a mortgage lender requires a current map or survey of the property, you will bear the cost of a new survey. We will order the survey if you or your lender desires and collect the survey fee from you at closing. You will, of course, be given copies of the survey at closing. It is important that you or your agent contact us well in advance of closing to inform us whether a survey is desired. If we do not hear from you or your agent regarding the decision to order a survey within seven days of closing, we will not order the survey.
A survey may be beneficial to you in determining, among other things, whether the property of your neighbor encroaches the property or whether an improvement has been erected which encroaches on the property. The title insurance company will insure you without a survey, but may reject a claim regarding defects that could have been disclosed by an accurate survey. It is our recommendation that every buyer obtain a survey at the closing.

You, your realtor, or your lender should ensure that the improvements on the property will be insured against flood, fire and other casualties with a reputable company, and that the insurance will be effective as of the date and time of closing. You, your realtor, or your lender should order the policy and ensure that it is delivered to us and the lender at least one day prior to the closing.

While it is customary to transfer the keys to the property at closing, the Standard Offer to Purchase indicates the keys shall be transferred at the time the Deed is recorded. The deed cannot be recorded until we have received all of the funds from you, your lender, and the seller, if applicable. As a general rule, we cannot record a deed the same day for a closing that is scheduled any later than 12:00 PM. We encourage you or your agent to discuss the transfer of keys with the seller before the closing and to contact us in the event that you have any questions.

We may choose to accept uncertified funds in the amount of $1,000 or less in our sole discretion. Please check with us before you bring us uncertified funds.
